1. Agreement to Terms
By accessing and using the services provided by Horizon Actif, you accept and agree to be bound by the terms and provision of this agreement. These terms apply to all visitors, users, and others who access or use our adventure tourism services in Canada. If you disagree with any part of these terms, then you may not access our services.
2. Adventure Tourism Services
Horizon Actif provides adventure tourism services including but not limited to mountain hiking, white-water rafting, rock climbing, winter sports, and guided wilderness expeditions across Canada. All activities are conducted with professional guides and safety equipment. Participants must meet specific age, health, and fitness requirements as outlined in individual activity descriptions.
We reserve the right to modify, suspend, or discontinue any service at any time without notice. Activity schedules may be subject to change due to weather conditions, safety concerns, or other circumstances beyond our control.
3. Booking and Payment Terms
All bookings must be made through our official website or authorized representatives. A deposit is required to secure your reservation, with full payment due according to the terms specified at the time of booking. Prices are subject to change without notice until full payment is received.
Cancellation policies vary by activity and season. Please review the specific cancellation terms for your chosen adventure before booking. Refunds, when applicable, will be processed within 14 business days of cancellation approval.
4. Safety and Liability
Adventure tourism activities involve inherent risks including but not limited to physical injury, property damage, or death. Participants engage in activities at their own risk and must follow all safety instructions provided by our guides. We maintain comprehensive insurance coverage, but participants are strongly encouraged to obtain personal travel and adventure sports insurance.
All participants must complete a liability waiver and medical disclosure form before participating in any activities. Pregnant women, individuals with heart conditions, or those with other medical concerns should consult their physician before participating.
5. Participant Responsibilities
Participants must arrive on time for scheduled activities with appropriate clothing and personal items as specified in pre-activity communications. Participants under the influence of alcohol or drugs will not be permitted to participate, and no refund will be provided.
Participants must disclose any medical conditions, medications, or physical limitations that could affect their ability to safely participate in activities. Failure to disclose relevant information may result in exclusion from activities without refund.
6. Environmental Responsibility
Horizon Actif is committed to environmental stewardship and sustainable tourism practices. All participants must follow Leave No Trace principles and respect wildlife and natural environments. Littering, damage to natural areas, or harassment of wildlife will result in immediate removal from activities.
We reserve the right to modify or cancel activities to protect sensitive environmental areas or comply with conservation regulations.
7. Photography and Media
During activities, our guides and staff may take photographs or videos for promotional purposes. By participating in our services, you consent to the use of your likeness in marketing materials, social media, and promotional content. If you prefer not to be photographed, please inform your guide at the beginning of the activity.
8. Intellectual Property
The content on our website, including text, graphics, logos, images, and software, is the property of Horizon Actif and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
9. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of our services, to understand our practices regarding the collection, use, and disclosure of your personal information.
10. Governing Law
These terms shall be interpreted and governed in accordance with the laws of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Alberta.
11. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.
